Terms of Service

1. Introduction

These terms govern the use of www.smartprep.co.za and services provided by SMARTPREPREMOTE (Pty) Ltd, registration number 2025/319485/07, at 9 The Grail Street, Edenburg, Sandton, 2191, South Africa (“SmartPrep”). They apply to students, parents, tutors, instructors, invigilators, scribes, readers, course creators and affiliates. By using a service, you agree to these terms.

2. Scope of services

Availability varies by subject, tutor and location. SmartPrep may decline a request it cannot serve safely or effectively.

• One-to-one and group tutoring, online or in person where offered.
• Academic support for school, university, college, professional and adult learners.
• Exam workshops, educational content and online learning.
• Scribing, reading and invigilation services.
• Access to education technology and recorded marketplace courses.

3. Accounts and access

You must provide accurate information, keep login details confidential and use SmartPrep’s official platforms. SmartPrep is not liable for loss caused by a user’s failure to secure their credentials.

4. Payments and refunds

Supported bursaries may purchase live tutoring and recorded marketplace courses, subject to the funder’s payment or claim route.

• All client payments are made to SmartPrep. Clients must not pay tutors directly.
• Prices are in South African rand and may be paid by an approved card, EFT, Intellimali or another displayed method.
• Private card and EFT bookings receive the published hours discount. Intellimali payments do not receive a volume discount.
• Tutors and contractors are paid within five business days after month-end once approved timesheets are received.
• Approved refunds for unused sessions are processed within 14 business days. Any discount is forfeited and used sessions may be recalculated at the applicable rate.
• No refund is due when service ends because of misconduct or a material breach.

5. Cancellations

Give at least ten hours’ written notice to cancel or move a lesson. A late cancellation may be charged at 50% and a no-show at 100%. If a tutor cancels, SmartPrep will reschedule the lesson or arrange a replacement at no extra charge.

6. Conduct

Clients must communicate respectfully, provide a suitable learning environment, avoid off-platform arrangements and uphold academic integrity. Tutors and service providers must be punctual, prepared, professional, confidential and submit accurate records. Breaches may lead to a warning, deduction where lawful, suspension or termination.

7. Intellectual property

SmartPrep materials and materials supplied by their original creators remain protected by intellectual-property law. They may not be copied, shared, sold, recorded or redistributed without written permission.

8. Service-specific terms

SmartPrep prioritises tutor compatibility but cannot guarantee a particular tutor. Trial lessons are charged at normal rates unless agreed otherwise. Confirmed group fees are non-refundable. Lessons or workshops may be recorded for delivery and quality purposes where participants have been informed; contact us before the session if you object. Course creators grant the licence needed to host and sell their content, with revenue sharing governed by a separate agreement.

9. Academic integrity

SmartPrep does not support cheating, plagiarism, impersonation or unauthorised assistance in a formal assessment. A tutor may assist in an assessment only where an institution has approved an accommodation. A breach may lead to immediate termination and legal or institutional reporting where required.

10. Privacy

Personal information is handled under POPIA and our Privacy Policy. We use reasonable safeguards and disclose information only for service delivery, with consent, or where the law requires it.

11. Liability and indemnity

You indemnify SmartPrep against loss caused by your breach, misuse or unauthorised conduct. To the extent permitted by law, SmartPrep is not liable for indirect or consequential loss, academic outcomes, or failures caused by third-party technology.

12. Force majeure

SmartPrep is not liable for delay caused by events outside reasonable control, including outages, natural disasters, civil disruption, labour action, public-health events or government restrictions.

13. Disputes and governing law

South African law applies. The parties must first try to resolve a dispute in writing, then by agreed mediation where appropriate, before approaching a court with jurisdiction.

14. Changes and contact

SmartPrep may update these terms by publishing a revised version and, for material changes, notifying affected users by email. Questions may be sent to info@smartprep.co.za.
